Terms of Service

1. Who we are & acceptance of these Terms

Allure of Kingdoms: Ancient Past ("AKAP", "the Game", "we", "us") is a free-to-play, browser-based text game operated by its independent developer (the "Operator") at allureofthepast.com. By creating an account or playing the Game you agree to these Terms of Service ("Terms") and to our Privacy Policy and Refund & Delivery Policy, which are part of these Terms. If you do not agree, please do not use the Game.

2. Eligibility

You must be at least 13 years old to play. If you are under the age of majority where you live, you may only play — and may only make purchases — with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. By making a purchase you confirm you are legally able to do so.

3. Your account

• You must provide a valid email address at registration. You are responsible for keeping your password secret and for everything that happens on your account.
• One person per account. Accounts may not be sold, traded, gifted, or transferred.
• Choose usernames and custom names (titles, goats, etc.) that are not offensive, misleading, impersonating, or infringing. We may rename or remove names that break this rule.
• Tell us at support@allureofthepast.com if you believe your account has been compromised.

4. The Game and virtual items

The Game is free to play. It includes virtual currencies and items, including Gold and Reputation (earned through play only) and Allure Points ("AP") (earned in small amounts through play and also available for purchase).

• Licence, not property. Virtual currencies and items are a limited, personal, revocable, non-transferable licence to use features within the Game. They are not your property, have no real-world monetary value, cannot be redeemed for money, and cannot be sold or exchanged outside the Game.
• No cash-out. We never buy back AP, Gold, or any virtual item.
• Balance changes. This is a living game. We may tune prices, rewards, drop rates, item effects, and game rules at any time to keep the Game fun and fair.
• Fixed value purchases. Purchased AP packages are fixed amounts at the price shown at checkout. We do not sell randomised items or "loot boxes" for real money. The daily "Royal Scratch-Off" is a free bonus that cannot be bought.

5. Purchases, billing and delivery

• Payments are processed by third-party payment providers (currently Stripe, and potentially PayPal). We never see or store your card number. The provider's own terms apply to the payment itself.
• The price, currency, and AP amount are shown at checkout before you pay. You may be responsible for applicable taxes.
• Delivery is automatic and near-instant: AP is credited to your account when the payment provider confirms payment, normally within seconds. See the Refund & Delivery Policy for what to do if it doesn't arrive.
• All purchases are logged in an auditable ledger tied to your account.

6. Refunds and chargebacks

Our Refund & Delivery Policy explains when refunds are available. In short: unspent AP can be refunded within 14 days of purchase on request; AP that has been spent in the Game cannot be refunded.

If you dispute a charge with your bank instead of contacting us first, the disputed AP will be removed from your account (which may leave a negative balance) and your account may be suspended while we investigate. Fraudulent chargebacks may lead to permanent account closure.

7. Fair play — prohibited conduct

You agree not to:

• use bots, scripts, macros, auto-clickers, or any automation to play;
• exploit bugs (found one? report it to support@allureofthepast.com — we thank bug reporters, we suspend bug abusers);
• attempt to access other players' accounts or the Game's servers, code, or database;
• interfere with the operation of the Game (including denial-of-service, scraping at disruptive rates, or probing for vulnerabilities without permission);
• use the Game for anything unlawful; or
• circumvent suspensions, purchase limits, or other technical measures.

8. Your content

Player-provided text (usernames, custom titles, goat names, and similar) must be your own, must not infringe anyone's rights, and must not be offensive, hateful, or unlawful. You grant us a worldwide, royalty-free licence to display that text within the Game (for example, on leaderboards). We may remove or edit player-provided text at our discretion.

9. Our intellectual property

The Game — including its code, writing, characters (yes, including Gerald the goat and the Royal Duck Advisor), game design, names, and branding — is original work created by the Operator and is protected by copyright and other laws. See About the Game for our statement of originality. You may not copy, redistribute, or create derivative works from the Game without written permission. Feedback and suggestions you send us may be used freely without obligation.

10. Availability and changes to the Game

We aim to keep the Game available and improving, but it is provided without uptime guarantees. We may add, change, or remove features, wipe or rebalance game data where necessary for fairness or technical reasons, and may suspend or discontinue the Game. If the Game is permanently discontinued, we will make reasonable efforts to give at least 30 days' notice on the website, during which AP purchases will be disabled.

11. Termination

• By you: you may stop playing at any time, and may request account deletion by emailing support@allureofthepast.com (see the Privacy Policy).
• By us: we may suspend or terminate accounts that violate these Terms, abuse other players, commit payment fraud, or where required by law. Where the violation is minor and curable we will normally warn first.
• On termination, your licence to virtual items ends and unused virtual items are forfeited without refund, except where a refund is required by applicable law or our Refund Policy.

12. Disclaimers

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE. THE GAME IS ENTERTAINMENT; NOTHING IN IT IS ADVICE OF ANY KIND, ESPECIALLY NOT THE TAX ADVICE OF A MAN IN A BARREL.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE GAME IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $20. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING WHERE CONSUMER LAW GIVES YOU RIGHTS THESE TERMS CANNOT CHANGE.

14. Indemnity

If your breach of these Terms causes a third-party claim against the Operator, you agree to cover the reasonable costs and damages arising from that claim.

15. Governing law

These Terms are governed by the laws of the Operator's country of residence, without regard to conflict-of-law rules, and disputes will be handled by the competent courts there — except that if you are a consumer, you keep any protection granted by the mandatory consumer laws of the country where you live.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will change, and material changes will be announced on the website. Continuing to play after changes take effect means you accept the updated Terms. If you don't agree, stop playing and, if you have unspent purchased AP, contact us within 14 days of the change for a refund of that AP.
